Introduction

New You Ministries, Inc., dba New You Ministries and each of their affiliates, subsidiaries and parent companies (collectively, “New You Ministries”, “us”, “we” or “our”) are pleased to provide you with access to and use of our websites, mobile and device applications, content, streaming services, products, services, goods, equipment, equipment interfaces, promotions, software, technology and any other materials (collectively, “New You Ministries Services”) that we may provide.

By accessing or using our services, programs, and facilities, you agree to be bound by the following Terms & Conditions Agreement. This Agreement outlines the terms under which you may participate in any activities or utilize any services provided by New You Ministries and its affiliates.

1. General Terms

1.1 Acceptance of Terms

By participating in any New You Ministries programs, events, workshops, or using any of our facilities, you agree to these Terms and Services. If you do not agree, you should discontinue use immediately.

1.2 Modification of Terms

New You Ministries reserves the right to modify these terms at any time without prior notice. It is your responsibility to review these terms periodically. Continued participation in our programs or use of our services constitutes acceptance of any changes.

2. Assumption of Risk

2.1 Acknowledgment of Risk

You acknowledge that participation in physical activities, wellness programs, workshops, or any events hosted by New You Ministries involves inherent risks. These risks may include, but are not limited to, physical injury, mental stress, or unforeseen circumstances.

2.2 Voluntary Participation

Your participation in any New You Ministries program is voluntary. You assume full responsibility for any risks, injuries, or damages known or unknown that might occur as a result of your participation.

3. Release of Liability

3.1 Waiver of Claims

To the fullest extent permitted by law, you hereby release, discharge, and hold harmless New You Ministries, its owners, board of directors, partners, employees, and affiliates from any and all liability, claims, demands, or causes of action related to any loss, damage, or injury, including death, that may be sustained by you during or as a result of participation in any New You Ministries activities, whether caused by negligence or otherwise.

3.2 No Liability for Third-Party Actions

New You Ministries shall not be held liable for the actions, omissions, or negligence of any third-party service providers, including but not limited to independent contractors, guest speakers, or affiliated organizations.

4. Health and Fitness

4.1 Medical Disclaimer

New You Ministries does not provide medical advice or treatment. You should consult with a physician or other qualified health professional before starting any new fitness, nutrition, or wellness program. You are solely responsible for your health and well-being.

4.2 Fitness Levels

You acknowledge that you are in good physical condition and do not have any medical condition that would prevent you from safely participating in any activities offered by New You Ministries. You agree to stop any activity if you feel unwell or unsafe.

5. Indemnification

You agree to indemnify, defend, and hold harmless New You Ministries, its owners, board of directors, partners, employees, and affiliates from any and all claims, liabilities, damages, and expenses, including attorneys' fees, arising from your participation in any activities or services provided by New You Ministries.

6. No Warranties

6.1 Disclaimer of Warranties

All services provided by New You Ministries are offered "as is" and without warranties of any kind, either express or implied. New You Ministries does not guarantee any specific outcomes from participation in its programs.

7. Governing Law

This Agreement shall be governed by and construed in accordance with the laws of Colorado, USA. Any legal action or proceeding arising out of or relating to this Agreement shall be brought exclusively in the courts of Colorado, USA.

8. Arbitration

Any dispute or claim arising out of or in connection with this Agreement shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. The arbitration will take place in Colorado, USA, and the arbitration award shall be final and binding on all parties. By agreeing to these terms, you waive the right to a trial by jury or to participate in a class action lawsuit.

9. International Users

Our websites are controlled, operated, and administered by New You Ministries from its offices within the United States of America. New You Ministries makes no representation or warranty that the materials contained within the New You Ministries Services are appropriate or available for use at locations outside of the United States, and access to them from territories where the contents or products available through the New You Ministries Services are illegal is prohibited. You may not use the New You Ministries Services or export the New You Ministries Services in violation of U.S. export laws and regulations. If you access the New You Ministries Services from a location outside of the United States, you are responsible for compliance with any and all local laws, rules, regulations, and ordinances.

10. Severability

If any provision of this Agreement, in its current form or as it may be amended, is found to be invalid or unenforceable for any reason, such provision shall be stricken and reformed only to the extent necessary to make it enforceable, and the balance of the Terms will remain in full force and effect. You hereby agree that the arbitrator or any adjudicator with appropriate jurisdiction pursuant to the Agreement shall enforce the Agreement to its fullest extent, while striking only those provisions that are found to be unenforceable, if any.

11. Suspension; Termination

New You Ministries may, in its sole and absolute discretion, suspend, disable, block, or terminate your access and use of any New You Ministries Services (including without limitation, deleting your account(s) or any part thereof), or block, remove, or delete any User Generated Content that you submitted, for any lawful reason, including if New You Ministries determines in its discretion that you violated these Terms (such as and including by way of example, to the extent your conduct or User Generated Content violates these Terms or could damage New You Ministries’s reputation or goodwill). If New You Ministries suspends, disables, blocks, terminates, or deletes your account, you may not re-register for or use the New You Ministries Services under any other login or profile. New You Ministries may block your access to the New You Ministries Services to prevent re-registration. You agree that New You Ministries will not be liable for any interruption or termination of your access and/or use of the New You Ministries Services.

12. No Third-Party Beneficiaries

Except as set forth in these Terms, only you and New You Ministries may enforce these Terms; no third party shall be entitled to enforce these Terms.

13. Survival

The provisions of these Terms which by their nature should survive the termination of these Terms shall survive such termination.

14. Waiver

No waiver of any provision of these Terms by us shall be deemed a further or continuing waiver of such provision or any other provision, and our failure to assert any right or provision under these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing signed by the Chief Legal Officer of New You Ministries in order to be effective.

15. Assignment

New You Ministries may assign these Terms to any person or entity at any time, for any reason, with or without notice to you.

16. Language

It is the express intent of the parties that these Terms and all related documents have been drafted in English (in the case of English versions)

17. Entire Agreement

This Agreement constitutes the entire understanding between you and New You Ministries concerning your participation in its programs and use of its services. It supersedes all prior agreements, understandings, or representations.

18. Data Protection and Privacy

New You Ministries is committed to protecting your privacy. By using our services, you agree to our collection and use of personal data as outlined in our Privacy Policy, which is incorporated by reference into these Terms. You are responsible for maintaining the confidentiality of your account information, including your username and password, and for all activities that occur under your account.

19. Acceptance

By using our services and signing up for our programs, you acknowledge that you have read, understood, and agree to the terms and conditions outlined in this Terms & Conditions Agreement.
